The attorney representing an Arkansas City man accused of shooting his stepson last month indicated Tuesday that the defense is expected to argue the shooting was an act of self-defense.
During a brief hearing Tuesday in the Arkansas City courtroom of Cowley County District Court Magistrate Judge David Maslen, Boone, 69, appeared remotely by Zoom. He is represented by Ottawa attorney Forrest Lowry.
The case stems from the July 21 shooting at a residence in the 1300 block of South H Street in Arkansas City.
Lowry briefly indicated the defense anticipates raising a claim of self-defense as the case moves forward.
He also requested a hearing to consider reducing Boone’s bond.
Boone remains jailed in the Cowley County Jail on allegations of aggravated battery, unlawful discharge of a firearm and possession of a firearm while under the influence. His bond is set at $250,000.
A hearing on Boone’s request for a bond reduction, along with the setting of a preliminary hearing, has been scheduled for 3 p.m. Tuesday before District Judge Christopher Smith at the Cowley County Courthouse in Winfield. Continue below ad.
According to the Arkansas City Police Department, officers responded at approximately 7:15 p.m. July 21 to the residence, where they found Boone’s 57-year-old stepson suffering from a gunshot wound to the leg.
An Arkansas City police officer applied a tourniquet to control the victim’s bleeding until Arkansas City Fire/EMS personnel arrived. The victim was treated at the scene before being airlifted by EagleMed to a Wichita hospital.
Police said the preliminary investigation indicated Boone and his stepson became involved in a physical altercation inside the residence before Boone allegedly produced a firearm and shot the victim.
Boone was also evaluated at the scene and initially declined medical transport before later seeking treatment at a local emergency room. He was subsequently transferred to a Wichita hospital and arrested after his release the following day.
