Cowley County commissioners Tuesday morning voted unanimously to approve an ordinance to restrict public nudity.
The vote took place at the courthouse assembly room in Winfield where commissioners held their regular meeting. One person spoke in opposition.
The ordinance will be enforceable following the required publishing of public notices. A fine of $500 and up to 30 days jail time is the punishment.
This is the prohibited conducted defined by the new ordinance:
“It shall be unlawful for any person to knowingly or intentionally appear in a state of nudity in a public place or on private property (outside of the home) where visible to others.”
The ordinance was developed and enacted in response to incidents in the IXL area of Ark City where a man had been going on nude walks.
Exceptions are made for certain circumstances including children under 10 and mothers who breastfeed.
